Article 6 explained in plain English
This article details how to deal with requests issued under Article (6) of the Law to provide records, documents or information:
- The role of the supervisory authority over the financial institution: on receiving the request it refers it immediately to the financial institution without alerting the party concerned, so that the institution provides what is requested to the supervisory authority within the specified period and in the manner and form specified in the request.
- The obligation of those other than financial institutions: any person, the specified non-financial businesses or professions, or non-profit organizations, on receiving the request, must provide what is requested within the specified period and in the manner and form specified.
- Notifying the requesting authority: the supervisory authority, on obtaining what is requested, must notify the requesting authority immediately and provide it with it within the period and in the form specified.
The practical meaning is that the account holder or party concerned is not alerted to the request when it is referred to the financial institution, and that the period and the manner are specified by the request itself and not by this article. The available text does not set out Article 6 of the Law.
Establishments that receive such requests may consult a lawyer specialized in banking and finance to understand their obligations.
Practical example
A finance company in Riyadh received, through its supervisory authority, a request to provide documents about a customer's account. It provides them within the period and in the form specified in the request, and the request was referred to it without alerting the customer.
