Article 5 explained in plain English
In implementation of Article (5) of the Law, this article sets time controls for what follows the arrest of a suspect in one of the crimes under the Law of Combating Crimes of Terrorism and its Financing:
- Immediate notification: the Public Prosecution is notified immediately and directly on the arrest.
- Presentation to the Public Prosecution: the suspect is brought before the Public Prosecution as soon as the evidence-gathering procedures are completed, and in no case later than seven days from the date of arrest.
- Extension: if the evidence-gathering procedures and hearing the suspect's statements require extending the period, the Presidency of State Security submits a reasoned request to the Attorney General or his delegate, who issues a written order extending it for a period or periods not exceeding seven days in total.
The practical meaning is that the maximum before the suspect is brought before the Public Prosecution, under this article, is seven days, extendable by no more than seven further days in total, and that an extension is made only by a reasoned request and a written order. The phrase "as soon as completed" means that presentation takes place when the evidence-gathering ends, even if that is before the period expires.
