Article 261 explained in plain English
This Article regulates what the salvor is entitled to. Salvage, according to Article 1, is the assistance given to a ship in danger, to those aboard it, or to what it carries, at its request.
- The reward: any salvage operation gives a right to a reward on condition that it leads to a useful result, and the reward may not exceed the value of what was saved.
- Expenses: if the salvage does not lead to a useful result, the ship to which it was provided is bound to pay the reasonable expenses incurred.
- Special compensation: if the ship or its cargo threatens the marine environment and the salvage did not lead to a useful result, and the salvor did not obtain the reward or expenses, he is entitled from the ship's owner to special compensation equal to the expenses, subject to:
- adding an amount not exceeding 30% of the compensation if the salvor prevented or reduced environmental damage to people or marine resources in the Kingdom's maritime areas.
- the competent court may award an increase in the special compensation not exceeding 100% of the expenses if it sees that this is right, after considering the bases set out in Article 267, including the value of what was saved, the danger, and the duration of the salvage.
- Who pays: the interested parties pay the salvage expenses and the special compensation, each according to the property saved that relates to him.
To assess what a salvor is entitled to in a particular case, it is advisable to consult a lawyer specializing in maritime matters.
Practical example
An oil tanker broke down near the eastern coast and asked for help. A salvage vessel tried to tow it but it sank anyway, though the salvor's efforts reduced the oil leakage reaching the coast. No useful result was achieved to entitle him to the reward, but the salvor is entitled to special compensation from the tanker's owner equal to his expenses, with an amount not exceeding 30% of the compensation added for reducing the environmental damage.
