Article 257 explained in plain English
This Article gives the claimant in a maritime collision action several options for where to bring his action. He may bring it before any of the following courts:
- the court in whose area is the defendant's domicile or principal place of business;
- the court in whose area is the port of registry of the defendant's ship;
- the court in whose area is the first Saudi port the ships or one of them reached;
- the court in whose area is the port where the ships or one of them were arrested;
- the court in whose area is the place of the collision, if it occurred in the Kingdom's maritime areas;
- any other court the parties agree to bring the action before.
Paragraph 2 allows the parties to agree to refer the dispute to arbitration, provided that it takes place, as the claimant chooses, within the area of one of the courts mentioned in paragraph 1. Arbitration is therefore permitted but limited by place to these options.
Article 258 sets the period after which an action for compensation for the collision is no longer heard. To choose the most suitable court in a particular dispute, it is advisable to consult a lawyer specializing in maritime matters.
Practical example
A ship of a Saudi company collided with a foreign ship in the Kingdom's territorial waters, and then both ships reached the port of Jeddah. The Saudi company may bring its action before the court in whose area the place of the collision lies, or the port of Jeddah as the first Saudi port the ships reached, or the other options in the Article.
