1 - تحدد قواعد الترخيص شروط منحه وإجراءاته, وواجبات المرخص له.
2- يقيد اسم المرخص له في قائمة الأمناء أو الخبراء، ولا يزال إلا في الحالات الآتية:
أ - انتهاء مدة الترخيص.
ب - صدور قرار لجنة الإفلاس بإيقاف الترخيص مؤقتًا أو شطبه.
3- إذا أخل المرخص له بواجباته أو بشروط الترخيص، فللجنة الإفلاس إيقاع أي من العقوبات الآتية:
أ - الإنذار.
ب - اللوم.
ج - إيقاف الترخيص مؤقتًا.
د - شطب الترخيص.
4- تعد قرارات لجنة الإفلاس الصادرة بالإيقاف أو الشطب نافذة من تاريخ تبليغها.

Article 91 explained in plain English
This article of the Regulations governs the licensing of trustees and experts in four provisions:
1. Licensing rules: the licensing rules set the conditions for granting a license, its procedures and the duties of the licensee. These details are not in the article itself.
2. Entry on the list: the licensee's name is entered on the list of trustees or experts, and is removed only in two cases:
- The license period ends.
- The Bankruptcy Committee issues a decision temporarily suspending the license or striking it off.
3. Penalties: if the licensee breaches his duties or the conditions of the license, the Bankruptcy Committee may impose on him one of the following penalties:
- A warning.
- A reprimand.
- Temporary suspension of the license.
- Striking off the license.
4. Effect of decisions: the Bankruptcy Committee's suspension or striking-off decisions take effect from the date of their notification, not from the date they are issued.
Note that the text does not tie each violation to a particular penalty; it lets the Committee impose any of the four penalties. Also, a warning and a reprimand do not in themselves lead to removal from the list, because removal is limited to the two cases mentioned.
It is followed by Article 92, which requires trustees and experts to comply with the Law, the Regulations, the rules issued by the Bankruptcy Committee and other relevant laws. A trustee or expert against whom a decision has been issued should preferably consult a lawyer specializing in bankruptcy and commercial cases.
Practical example
An accountant in Riyadh licensed as a bankruptcy trustee repeatedly delayed performing his duties in one procedure. The Bankruptcy Committee may impose on him a warning, a reprimand, temporary suspension or striking off. If it decides on temporary suspension, the decision takes effect from the date he is notified of it, and his name is removed from the list of trustees.
