Article 85 explained in plain English
This article of the Regulations opens the chapter on the Bankruptcy Committee and lists its powers, subject to Article 9 of the Bankruptcy Law.
All of the Committee's powers concern issuing rules on the following:
- Rules for keeping and managing the bankruptcy register, and the register provided for in paragraph 2 of Article 204 of the Law.
- Licensing rules for trustees and experts.
- Rules regulating the work of bankruptcy trustees and experts, in coordination with the Ministry of Justice.
- Professional conduct rules for trustees and experts.
- Inspection and verification rules.
- Rules for nominating trustees and experts, in coordination with the Ministry of Justice.
Note that the text requires coordination with the Ministry of Justice in only two items: the rules regulating the work of trustees and experts, and the rules for nominating them.
This means that anyone who wants to work as a trustee or expert, or deals with them, will not find the details of licensing, professional conduct and nomination in this article, but in the rules the Committee issues.
It is followed by Article 86, which makes inspection, verification and seizure the work of the staff of the General Secretariat of the Bankruptcy Committee who are named by a decision of the Committee. This article does not explain the content of Article 9 of the Law or of the register referred to in Article 204. Anyone who needs to know the rules that apply to his case may consult a lawyer specializing in bankruptcy and commercial cases.
