Article 22 explained in plain English
This article of the Implementing Regulations of the Bankruptcy Law sets basic rules on when the trustee's work begins and ends.
- When does the trustee start? The trustee begins his tasks from the date the bankruptcy procedure opens, unless the court's judgment opening it states another date.
- Several trustees: If the court appoints more than one trustee, its judgment must include a statement of their tasks and powers.
- Another person made subject to the procedure: If the court rules that another person is subject to the procedure opened for the debtor, it may appoint for that person a trustee who is listed on the trustees' list. This article does not say when another person becomes subject to the procedure.
- When the procedure ends: As soon as the bankruptcy procedure ends, the trustee gives the debtor all the debtor's assets in his possession, all records, correspondence and claims, and any other information or documents related to the procedure that he obtained or created while working as trustee.
The text uses the words "as soon as" and "all": delivery is required immediately when the procedure ends, and it covers everything the trustee holds that relates to the procedure.
Relation to neighboring articles: Article 23 regulates the removal and withdrawal of the trustee, and requires a removed or withdrawing trustee, while the procedure is in progress, to hand the new trustee, under a record signed by both, within 14 days of the court's decision, all the debtor's assets, records, correspondence, claims and documents in his possession. Article 21 requires a debtor who is a natural person and was not discharged from a remaining debt to notify his creditors if he starts an activity within 24 months of the end of the liquidation.
Anyone who needs to know the limits of a trustee's powers in a particular procedure is advised to refer to the appointment judgment and to consult a lawyer who specializes in bankruptcy cases.
Practical example
A judgment opened a bankruptcy procedure for a company in Riyadh, and the court appointed two trustees and stated their tasks and powers in its judgment. When the procedure ended, the two trustees handed the company all the assets, records, correspondence, claims and documents related to the procedure that they held.
