Article 89 explained in plain English
This article of the Regulations governs the bankruptcy register in three respects:
1. How filing is done
Documents and information are filed in the bankruptcy register electronically, on the form specified for that purpose.
2. Public access to the register
The register is made available to the public on the Bankruptcy Committee's website. The register is not limited to the parties to the procedure; anyone can consult it, for example someone who wants to deal with a company and wishes to know whether it is in a bankruptcy procedure.
3. Duty to update
Everyone who has filed a document or information in the register must update it whenever it changes. Responsibility for the accuracy of the filed information remains with the person who filed it.
The article follows Article 88, under which the Bankruptcy Committee, in coordination with the Ministry of Justice, specifies the information and documents and publishes them in the Official Gazette. It is followed by Article 90, which deals with another register, the one provided for in paragraph 2 of Article 204 of the Law, and restricts access to it to specified data after the penalty judgment becomes final.
The article does not set a deadline for updating or a penalty for failing to update. Anyone who needs to understand the effect of what is filed in the register on his dealings may consult a lawyer specializing in bankruptcy and commercial cases.
Practical example
Before a contracting company in Riyadh signed a supply contract with a new establishment, its procurement manager visited the Bankruptcy Committee's website and consulted the bankruptcy register to check the establishment's status, because the register is open to the public.
