Article 90 explained in plain English
This article regulates the committee competent to consider fine violations and the route for objecting to its decisions. Paragraph (1) was amended by Royal Decree No. (M/67) dated 12/8/1442 AH, and the explanation here is of the text in force.
Paragraph (1) – Formation and jurisdiction of the committee:
- It is formed by decision of the Minister.
- It consists of three members, at least one of whom is a Sharia or legal adviser.
- It has jurisdiction to consider the violations and apply the fines set out in Articles 75, 76 and 77.
Paragraph (2) – Approval of decisions and appeal:
- The committee's decisions are approved by the President.
- Anyone against whom the decision is issued has the right to appeal it to the Board of Grievances in accordance with its law.
Paragraph (3): the regulations set the committee's working mechanism and the remuneration of its members.
Note that the committee's jurisdiction is limited to the three articles mentioned by number. The article does not set a deadline for appealing to the Board of Grievances, but refers to its law.
It is followed by Article 91, which makes investigating violations of the Law and pursuing the case before the criminal court the responsibility of the Bureau of Investigation and Public Prosecution, without prejudice to paragraph (1) of this article. Anyone against whom a committee decision is issued and who wishes to appeal would be wise to consult a lawyer who specializes in administrative cases.
