Article 2 explained in plain English
This article sets out the licensing conditions for anyone who wants to carry on periodic technical inspection. The body competent to license is the Saudi Standards, Metrology and Quality Organization, which grants the license:
- According to the geographic areas it sets inside the Kingdom.
- According to the classification it sees fit, such as the distinction between station, center and workshop in Article 1.
The license is not granted until five requirements are met:
- A commercial registration in the field of providing periodic technical inspection work.
- Acceptance from the Authority, which under Article 1 is an assessment the Authority carries out of the adequacy of the inspection body under the regulation for accepting conformity assessment bodies.
- A municipal license under the conditions that regulate it.
- A safety license from the General Directorate of Civil Defense under the conditions that regulate it.
- Meeting the site requirements and controls as the Implementing Regulations specify.
In practice, an investor is not enough with a commercial registration alone, but needs all of these requirements together. The details of the site requirements are found in the Implementing Regulations. Article 3 completes the rule, as it also gives the Authority the granting of licenses to inspection bodies that wish to provide mobile periodic technical inspection services. Anyone planning this activity would do well to consult a lawyer who specializes in commercial cases.
Practical example
A company in Riyadh wanted to open a periodic technical inspection center. It obtained a commercial registration in this activity, but it also needs acceptance from the Authority, a municipal license, a safety license from Civil Defense, and to meet the site requirements in the Implementing Regulations before the Authority grants it the license.
