Article 18 explained in plain English
This Article protects the worker from the employer's default. Under Article 7, the employer pays half of the contributions monthly and the subscriber pays the other half, and an employer may be late or refuse to pay. Here the Article provides that the employer's failure to pay contributions does not affect the beneficiary's entitlement to compensation.
What does this mean?
- A beneficiary who meets the conditions of entitlement is not deprived of compensation because the employer defaulted on payment.
- The protection is given to the beneficiary, who under Article 1 is the unemployed subscriber who meets the conditions of entitlement to compensation. So the Article does not replace the other conditions in Article 8, such as nationality, completing work periods and registering with the Ministry.
The Article does not relieve the employer of their obligation: the employer must apply the Law and the Implementing Regulations under Article 4, and is exposed to the fines the Law provides for violating its provisions. The Article also does not explain how unpaid contributions are collected from the employer.
Article 19 follows, regulating combining compensation with social insurance compensations. Anyone whose application is refused because of the employer's non-payment may object through the routes the Law provides, and may consult a lawyer specialized in social insurance.
Practical example
Bandar worked two years at a small business in Abha, then his contract was ended for a reason beyond his control, and he found that the business had not paid some contributions. If he meets the conditions of entitlement, the business's failure to pay does not affect his entitlement to compensation.
