Article 3 explained in plain English
This article sets the scope of application of the Law according to the country from which the imports come:
Paragraph 1 - member states of the Organization: the procedures of investigations and reviews, and any measures resulting from them, apply to imports directed to the Kingdom from member states of the World Trade Organization, in accordance with the provisions of the Law and the Implementing Regulations.
Paragraph 2 - non-member states: when conducting investigations and reviews on imports from these states, the Governor may choose between:
- applying all the provisions of the Law and the Implementing Regulations.
- applying part of them.
- taking different procedures.
This is subject to one condition: that what he takes does not conflict with the Kingdom's international commitments.
According to Article 1, "the Organization" is the World Trade Organization, "the Governor" is the governor of the General Authority for Foreign Trade, and "imports directed to the Kingdom" are imports directed to domestic consumption in the Saudi market.
This article follows Article 2, which sets the aims of the Law in protecting the domestic industry, safeguarding against a surge in imports and defending exports. Article 4 then identifies the implementing bodies; the Authority carries out the tasks of trade remedies in line with the Kingdom's international commitments, particularly the anti-dumping, subsidies and safeguards agreements. A person who imports from a non-member state and is affected by an investigation can consult a lawyer who specializes in international trade and foreign investment matters.
