Article 21 explained in plain English
This article deals with the consequences of the President's decisions based on the public interest:
Paragraph 1 - when measures are reduced: if the President decides to reduce the level of measures for public interest considerations, contrary to the final findings of the investigations, the final review or the review of extending safeguard measures, the Authority, before announcing the President's decision, re-determines the measures imposed in accordance with the percentage of reduction set by the President.
Paragraph 2 - when measures are not imposed or not extended: if the President decides not to impose final measures or not to extend them for public interest considerations, the domestic industry has no right to file a complaint:
- Concerning the same product that was under investigation,
- From the same exporter,
- For at least 6 months from the date of the President's decision.
The purpose of this bar is to prevent a new complaint being filed right after the decision in order to get around it. Note that the bar is limited to the same product and the same exporter.
This article is linked to Article 20, which gives the President, when imposing or extending final measures, the power to impose or extend them, reduce their level or duration, or not impose or extend them, by a reasoned decision. Article 22 follows, requiring the Authority and everyone participating in or having access to the investigations to keep confidential information confidential. Anyone representing a domestic industry affected by a decision of this kind may consult a lawyer specialized in international matters and foreign investment.
Practical example
The President decided not to impose anti-dumping duties on imports of a type of powdered milk from a certain exporter, for public interest considerations. Local dairy factories have no right to file a new complaint concerning the same product from the same exporter until at least 6 months have passed from the date of the decision.
