Article 19 explained in plain English
This article opens the door to bodies that are not parties to the trade dispute but are affected by its outcome. Under Article 1, persons with a public interest are the government bodies, institutions and civil associations in the Kingdom that do not fall within the definition of interested parties and have a view on the effect of measures on the public interest, such as bodies concerned with consumers, public health and market competitiveness.
- Declaring themselves: persons with a public interest declare themselves within the period set by the Implementing Regulations in the announcement of the start of investigations, final reviews and reviews of extending safeguard measures.
- Submitting information: they submit to the Authority information supported by documents and evidence on the effect of the measures on the public interest, and whether imposing, extending, not imposing or ending them serves the public interest, within the periods announced by the Authority and in accordance with the Implementing Regulations.
- Public file: non-confidential information is kept in a public file open to the interested parties and to persons with a public interest participating in the investigations, final reviews or reviews of extending safeguard measures, and they may submit their views on it in accordance with the Implementing Regulations.
Note that participation is limited to the three types of proceedings mentioned and tied to the set periods.
This article comes after Article 18 on monitoring customs items, and is followed by Article 20, which provides that the Authority submits public interest information to the President with the final findings without evaluating it, that it does not affect the final findings, and that when imposing or extending measures the President decides matters relating to the public interest. Anyone representing a body that wishes to participate may consult a lawyer specialized in international matters and foreign investment.
Practical example
A civil consumer protection association believes that imposing anti-dumping duties on a type of household appliance will raise prices for families. It can declare itself within the period set in the announcement of the start of the investigation, and submit to the Authority information documented with evidence on the effect of the duties on the public interest.
