Article 22 explained in plain English
Companies submit sensitive data on their prices, costs and production in investigations, so this article protects its confidentiality:
Paragraph 1 - who must keep confidentiality: the Authority and all participants in and persons with access to the investigations, including board members, employees, contractors and representatives of the Authority. The obligation covers confidential information connected with investigations and reviews, whether it is:
- Specific to interested parties or persons with a public interest.
- Specific to the reports the Authority prepares.
- Any confidential information they obtained by virtue of their jurisdiction or their work on trade remedies.
Paragraph 2 - the Authority's regulatory duties:
- Taking the necessary measures to ensure confidential information is kept.
- Regulating its circulation and access to it by those entitled to see it.
- Separating the confidential data files from the public files that the interested parties and the participating persons with a public interest may view.
It is followed by Article 23, which prohibits disclosing confidential information except with the written consent of its owners, by a final court judgment, or by a binding order from the competent court, and applies the Law on Penalties for Publishing and Disclosing Confidential Documents and Information to anyone who violates paragraph (1) of that article. It is preceded by Article 21 on the effects of the public interest decision. Anyone who believes their company's confidential information has been disclosed may consult a lawyer specialized in criminal matters.
Practical example
An exporting company submitted to the Authority detailed data on its production costs during a dumping investigation. The Authority's employees, its contractors and everyone who saw this data are bound not to disclose it, and the Authority keeps it in a confidential file separate from the public file that the other participants may view.
