Article 18 explained in plain English
This article regulates the role of Customs in gathering information the Authority needs, in two cases:
1) For the purposes of investigations: the Zakat, Tax and Customs Authority, at the request of the Authority, when an investigation begins or when provisional or final measures are imposed or when needed, does the following:
- Applies a mechanism for monitoring customs items.
- Creates customs sub-items for the product under investigation or subject to the measure.
- Provides monthly reports to the Authority to follow the monitoring and changes in the volume and price of the product.
2) For the purposes of anti-circumvention review: Customs, at the request of the Authority, when an investigation begins or when measures are imposed, applies a suitable mechanism for monitoring customs items or creates sub-items for products related to the product under investigation or measure, as the Authority sees fit, and provides monthly reports of the information.
The difference between the two paragraphs is that the first concerns the product itself, while the second extends to related products, because circumvention may take place through modified products or parts.
This article comes after Article 17, which makes the application and collection of measures run through Customs, with the Authority notified monthly of collection information. Article 19 follows, regulating the participation of persons with a public interest by declaring themselves and submitting their information. Anyone who notices that a customs sub-item has been created for a product they import may consult a lawyer specialized in international matters and foreign investment.
