Article 17 explained in plain English
This article moves from the decision stage to the implementation stage:
- Collection: provisional and final measures are applied and collected through the Zakat, Tax and Customs Authority on imports directed to the Kingdom, and separately from customs tariff duties and other service fees or taxes. Customs notifies the Authority monthly of application and collection information, such as the quantity and value of imports and the volume of measures collected.
- Price undertakings: at the request of the Authority, Customs registers the imports of the exporter that gave the undertaking and provides monthly reports.
- Quantitative restrictions: by decision of the Authority, Customs registers imports of the product from all sources, monitors the level of quotas and provides monthly reports. The Authority may require prior import licenses to regulate quotas on the basis of the President's decision.
- Shipments inside Customs: the President's decisions imposing measures apply to imports as long as they have not left the customs area before the date the decision takes effect, as do measures with retroactive effect under paragraph (3) of Article 5.
Paragraph (3) of Article 5 provides that final measures apply to imports on the basis of the decision imposing them, and retroactively to products subject to provisional measures, imports subject to registration and monitoring, and imports subject to registration when the conditions for final collection are met.
It comes after Article 16, which sets the content of the President's decision and makes it effective from the day after its publication unless it sets another date, and before Article 18, which regulates monitoring of customs items for the purposes of investigations. Anyone whose shipment was affected by a new decision while it was in Customs may consult a lawyer specialized in commercial matters.
Practical example
A shipment of wooden panels arrived at the Jeddah port, and before it left the customs area, a decision imposing anti-dumping duties on it took effect. The duties apply to this shipment because it had not left the customs area before the decision took effect, and the Zakat, Tax and Customs Authority collects them separately from ordinary customs duties.
