Article 16 explained in plain English
This article regulates the form of decisions and how they are announced:
1) Content of the President's decision: provisional and final measures are imposed by a decision of the President that includes:
- A description of the product subject to the measures and the customs item or items under which it is imported.
- The period the measures apply, including any period of retroactive effect, and whether they are provisional or final.
- The type of measures: percentage duties, monetary amounts, quantitative restrictions, price undertakings, guarantees, a combination of these, or any other suitable form.
- The parties they apply to, whether measures specific to exporters or producers, or general measures on the imports of the countries concerned, and any other criteria.
2) Public announcement and publication: the announcement includes the President's decision and a summary of the report on the preliminary or final findings with the most important facts and rulings relied upon, taking into account the confidentiality of information. The announcement and decision are published in the Official Gazette, and the President's decisions are effective from the day after the date of publication unless the decision sets another date.
3) Other decisions: the two preceding paragraphs apply, with the necessary changes, to decisions to open, end and suspend investigations and reviews, and to end, not impose or modify measures.
4) Safeguards Committee: in safeguard investigations, in addition to the public announcement, the Authority must notify the WTO Safeguards Committee immediately of decisions and procedures in accordance with the Implementing Regulations.
It comes after Article 15 on anti-circumvention review, and before Article 17, which makes the application and collection of measures run through the Zakat, Tax and Customs Authority. Anyone who needs to establish when a particular decision takes effect for their shipments may consult a lawyer specialized in international matters and foreign investment.
Practical example
The President's decision imposing anti-dumping duties on a type of pipe was published in the Official Gazette, and it did not set another date for taking effect. It therefore takes effect from the day after the date of publication, and the decision includes a description of the product and its customs items, the rate of duty and the exporters concerned.
