Right to Trace and Transfer of Collateral in the Saudi Law on Security Rights in Movable Assets

حق التتبع ونقل ملكية الضمانة — نظام ضمان الحقوق بالأموال المنقولة

The ban on the grantor transferring ownership of the collateral without the secured party's consent or outside its ordinary business; and the secured party's right to trace the collateral into any hands to satisfy its right when ownership is transferred in breach.

Article 22
The article bars the grantor from transferring ownership of the collateral without the secured party's consent unless in his ordinary course of business, and gives the secured party under an effective right the right to follow the collateral into any hands on breach.
1- لا يجوز للضامن نقل ملكية الضمانة، إلا بموافقة المضمون له أو إذا كان ذلك في إطار الأعمال المعتادة للضامن. 2- يترتب على نقل ملكية الضمانة -بالمخالفة للفقرة (1) من هذه المادة- في حق الضمان النافذ في مواجهة الغير؛ حق المضمون له في تتبع الضمانة في أي يد لاستيفاء حقوقه.
