Article 15 explained in plain English
Article 15 regulates the rules for promotion of members of the Authority, in four paragraphs:
- Promotion to Head of an Investigation and Prosecution Department (B) and below: what counts is the order of seniority in the rank. In case of a tie, the more competent is preferred according to efficiency reports, and in case of a tie or if there are no efficiency reports, the older is preferred.
- Promotion to Head of Investigation and Prosecution (A) and above: the assessment of efficiency, work, achievements and responsibilities is taken into account according to the assessment of the Authority's Council, the inspectors' reports and the facts of the work, taking into account any disciplinary penalties in the record; in case of a tie the more senior in the rank prevails.
- The inspection requirement: a member may be promoted only if he has been inspected at least twice in the rank he is to be promoted from, and the last two reports show that his efficiency is not below average. One inspection is enough for Investigator (C), unless the Authority's Council sees otherwise for reasons it assesses.
- Effect of appointment and promotion: the member must carry out the duties of the post promoted to at its seat, and the appointment or promotion takes effect only by carrying out its duties after the royal order is issued, unless the Authority's Council sees fit to second the member or loan him to another place.
It is followed by Article 16, which makes transfer, secondment and loan of members a decision of the Authority's Council, the period of secondment or loan being one year renewable for another year. Anyone who has been passed over for promotion by a more recently appointed colleague may consider consulting a lawyer specializing in administrative cases (the Board of Grievances).
Practical example
Two investigators in the rank of Investigator (B) have the same seniority, and the efficiency assessment of one is "above average" and the other "average". On promotion to Investigator (A), the more competent is preferred according to efficiency reports, provided each has been inspected at least twice in his rank.
