Article 95 explained in plain English
This article regulates an officer's sick leave, and sets its balance over a three-year period as follows:
- twelve months at actual salary.
- six months at half of actual salary.
So the total sick leave an officer may be entitled to over three years is eighteen months: the first twelve at his full actual salary, and the next six at half of it.
The practical meaning is that the balance is calculated over three years, not one year, so for an officer who needed long sick leave in one year, what he has used during the three-year period is looked at. The calculation is based on actual salary as stated in the text.
This wording is in force by Royal Decree No. (M/34) dated 8/7/1426 AH.
The article does not specify how the three-year period is calculated (from what date it begins), nor what follows after the eighteen months are used up, nor the procedures for proving illness.
An officer who has used up his balance or has a dispute over how it is calculated may consult a lawyer specializing in administrative cases and military service matters.
Practical example
Captain Fahd fell ill and needed long treatment, so he took fourteen months of sick leave within three years. The first twelve months are paid at his full actual salary, and the next two at half of actual salary, leaving four months of the balance at half salary.
