Article 94 explained in plain English
This article regulates an officer's extraordinary leave, and its conditions are:
- Reason: compelling circumstances.
- Granting authority: whoever has the power to grant leave under Article 89.
- Duration: not more than one month.
- Exhaustion condition: the officer must have used up his ordinary leave.
- How it is counted: its duration is counted against his future ordinary leave.
The practical meaning is that this leave resembles an advance on the balance of coming leave; an officer who has used up his balance and faces compelling circumstances can obtain leave of up to a month, but it is deducted from his ordinary leave in the future.
Referring to Article 89, leave outside the Kingdom is granted with the approval of the Minister or the Chief of the General Staff if the Minister has delegated it to him, and inside the Kingdom by heads of bodies, area commanders, branch directors and directors of similar departments.
The article is permissive, in the word "may", so the grant depends on the discretion of the person with the power. The article does not define what counts as compelling circumstances, and does not address what is paid to the officer during this leave. An officer whose request is refused may consult a lawyer specializing in administrative cases and military service matters.
Practical example
Major Anas used up his ordinary leave for this year, and then needed to accompany his son for emergency treatment. He may be granted extraordinary leave of up to a month, on the basis that the days he takes are deducted from his ordinary leave next year.
