Article 90 explained in plain English
This article regulates shortening, postponing or cutting short ordinary leave:
The power: whoever has the power to grant leave may shorten, postpone or cut it for reasons required by service circumstances in the armed forces.
When leave is cut short, the article distinguishes between two cases:
- If he has not taken two-thirds of his leave: he is compensated for his travel there and back and for the expenses of his family's return if he had previously taken them with him or moved them from his place of work because of enjoying the leave, and the remaining part of his leave is preserved for him.
- If he has taken two-thirds of his leave or more: only the remaining part is preserved for him.
The practical meaning is that the criterion for financial compensation is the proportion of the leave he has taken; an officer whose leave is cut at its start is compensated for travel costs, and one whose leave is cut after he has taken two-thirds or more is not compensated financially. But in both cases the remaining part of his leave is not forfeited.
Note that compensation for family expenses depends on his having taken them with him or moved them because of the leave. An officer whose leave is cut and who is not compensated may consult a lawyer specializing in administrative cases and military service matters.
Practical example
Captain Sami began a 45-day ordinary leave and traveled with his family, and after 10 days his leave was cut because of service circumstances. Because he had not taken two-thirds of his leave (30 days), he is compensated for his travel there and back and for the expenses of his family's return, and the remaining 35 days are preserved for him.
