Article 96 explained in plain English
This article regulates an officer's work-injury leave, and its conditions are:
- The officer must suffer a wound or illness.
- It must temporarily prevent him from performing his work.
- It must occur during his work and because of it.
The ruling: he is entitled to sick leave in place of the leave provided for in Article 95, lasting a year and a half at full salary. Article 95 provides for ordinary illness twelve months at actual salary and six months at half of it within three years; an officer injured during work and because of it receives a period of similar length but all of it at full salary.
After the period ends: if he has not returned to his work, his case is referred to the medical committee to decide one of two things:
- to recommend his referral to retirement.
- or to extend his leave, specifying the additional period, in which case he is paid half salary.
The essential difference between this leave and ordinary sick leave is the condition that the injury occur both during work and because of it; it is not enough that it occur during work without being because of it. This wording is in force by Royal Decree No. (M/37) dated 26/9/1423 AH.
An officer injured during his work who wants to prove that the injury was because of work may consult a lawyer specializing in administrative cases and military service matters.
Practical example
First Lieutenant Saud suffered a fracture during an official military exercise that temporarily prevented him from working. He is entitled to sick leave of a year and a half at full salary instead of ordinary sick leave. If he does not recover after that, his case is referred to the medical committee to recommend his referral to retirement or an extension of his leave at half salary.
