Article 9 of the Saudi Narcotics Law Implementing Regulations
المادة 9 من اللائحة التنفيذية لنظام مكافحة المخدرات والمؤثرات العقلية
The article sets conditions for importing and exporting narcotic and psychotropic substances for legitimate purposes: licensing, the approved annual need, the duration, renewal and data of licenses, and the means of transport.

1- يجب أن تكون المنشأة الخاصة - الراغبة في استيراد المواد المخدرة أو المؤثرات العقلية أو تصديرها لأغراض مشروعة - مرخصة من وزارة الصحة أو الهيئة العامة للغذاء والدواء كل بحسب اختصاصه .
2- يجب أن يكون لدى المنشأة الحكومية أو الخاصة احتياج سنوي معتمد من الهيئة العامة للغذاء والدواء.
3- تمنح رخصة الاستيراد لمدة سنة حدا أقصى تنتهي صلاحيتها بنهاية سنة الاحتياج .
4 - شروط تجديد رخصة الاستيراد:
أ - أن يكون ترخيص المنشأة الخاصة ساري الصلاحية .
ب - أن يكون لدى الجهة الطالبة احتياج معتمد من الهيئة العامة للغذاء والدواء للسنة المراد التجديد خلالها ، يغطي الكمية المطلوب استيرادها.
ج - في حالة وجود تأخير في الاستيراد، فيجب على المنشأة تقديم ما يثبت أن التأخير كان لأسباب مقبولة .
5 - على الجهة طالبة التصدير تقديم إذن استيراد ساري الصلاحية من الدولة المراد التصدير إليها مشتمل على ما يلي:
أ - اسم وعنوان الجهة المستوردة والجهة المستفيدة والشركة الصانعة والمصدرة.
ب- اسم المادة العلمي والتجاري وشكلها الصيدلاني وتركيزها وحجمها وعبوتها وكميتها والوزن النقي لها .
6 - تمنح رخصة التصدير لمدة تماثل مدة صلاحية إذن الاستيراد الصادر من الدولة المراد التصدير إليها، على ألا تتجاوز مدة صلاحيتها سنة .
7 - شروط تجديد رخصة التصدير:
أ - أن يكون ترخيص المنشأة الخاصة ساري الصلاحية .
ب- أن يكون لدى الجهة الطالبة احتياج معتمد من الهيئة العامة للغذاء والدواء للسنة المراد التجديد خلالها ، يغطي الكمية المطلوب تصديرها .
ج - أن تكون رخصة الاستيراد الصادرة من الدولة المراد التصدير إليها سارية المفعول ومطابقة لبيانات رخصة التصدير .
8 - يجب أن تشتمل رخصة الاستيراد أو التصدير على البيانات الآتية:
أ - اسم وعنوان الجهة المستوردة والجهة المستفيدة والشركة الصانعة والمصدرة.
ب- اسم المادة العلمي والتجاري وشكلها الصيدلاني وتركيزها وحجمها وعبوتها وكميتها والوزن النقي لها .
ج - تعليمات الرخصة التي تحددها الهيئة العامة للغذاء والدواء.
9 - يكون استيراد المواد المخدرة والمؤثرات العقلية بوساطة النقل الجوي ، وللهيئة العامة للغذاء والدواء بالاتفاق مع وزارة الداخلية السماح باستخدام وسائل نقل أخرى. وعلى المستورد أن يتقيد بشروط ومواصفات نقل وشحن المواد المخدرة والمؤثرات العقلية التي قررتها الشركة الصانعة، والشروط المنصوص عليها في الاتفاقيات الدولية والأنظمة السارية في المملكة.
10- لا يجوز استيراد عينات المواد المخدرة أو المؤثرات العقلية إلا للتسجيل فقط.

Article 9 explained in plain English
This article regulates the legitimate import and export of narcotic and psychotropic substances, such as medicines. Its main provisions are:
- Licensing: a private establishment wishing to import or export must be licensed by the Ministry of Health or the Saudi Food and Drug Authority, each according to its jurisdiction.
- Annual need: a government or private establishment needs an annual need approved by the Authority.
- Import license: its term is one year at most and it ends at the end of the year of the need. To renew it, the private establishment's license must be valid, there must be an approved need for the new year covering the quantity, and it must be shown that any delay in importing was for acceptable reasons.
- Export: the applicant submits a valid import permit from the importing country containing the details of the bodies and the substance. The term of the export license equals that of the import permit and does not exceed one year. To renew it, the establishment's license must be valid, there must be an approved need covering the quantity, and the other country's import license must be valid and match.
- License data: the names and addresses of the importing, beneficiary, manufacturing and exporting bodies, the scientific and trade name of the substance, its form, concentration, volume, packaging, quantity and pure weight, and the Authority's instructions.
- Transport: import is by air, and the Authority, in agreement with the Ministry of Interior, may allow other means, subject to the manufacturer's conditions, agreements and laws.
- Samples: they may not be imported except for registration only.

A pharmaceutical company in Jeddah wants to import a medicine containing a psychotropic substance. It needs a valid license and an annual need approved by the Authority, and it obtains an import license that ends at the end of the year of the need, with shipping by air unless other means are allowed.
