Article 28 of the Saudi Military Retirement Law

This article deals with the case of a military member who no longer holds Saudi Arabian nationality. Instead of a pension, he is granted an award calculated under the provisions of Articles 9 and 10.

Method of calculation under Article 9:

• For a person whose service ended without a disciplinary judgment and not by dismissal for absence or by operation of law for committing a crime: one month's salary for each year of the first five years of actual military service, two months' salary for each year of the next five, and three months' salary for each year beyond that.
• For a person whose service ended by a disciplinary judgment or dismissal for absence or for committing a crime: one month's salary for each year of the first five, and two months' salary for each year beyond that, unless the judgment deprives him of the award.

The salary used under Article 10: the award provided for in Article 9 is granted on the basis of the last salary the military member was receiving.

This provision is consistent with the scope of the law, since Article 2 defines the military member as one subject to the officers' service and enlisted personnel service laws, and defines the award as a lump sum paid once instead of a pension.

This article was amended by Royal Decree No. (M/80) dated 20/8/1443 AH, and the text shown is the one in force. Article 10 bis contains provisions on attachment of the pension or award up to 25%, with priority for maintenance debts, and these also apply to the award.
