Article 9 explained in plain English
This article deals with the case of a military person who is not entitled to a pension, that is, in cases other than those mentioned in Article 7. It grants him an award calculated according to the reason his service ended:
Paragraph (a): a person whose service ended for an ordinary reason
That is, without a disciplinary ruling, and without dismissal because of absence or by operation of law for committing a military or civil crime:
- the salary of one month for each year of the first five years of actual military service.
- the salary of two months for each year of the following five years.
- the salary of three months for each year beyond that.
Paragraph (b): a person whose service ended by a disciplinary ruling or dismissal for absence or a crime
- the salary of one month for each year of the first five years.
- the salary of two months for each year beyond that.
- unless the ruling issued against him provides for depriving him of this award.
The award is calculated on actual military service. Article 10 provides that the award in this article is granted on the basis of the last salary the military person was receiving.
The cases of entitlement to a pension in Article 7 include, for example, actual service reaching 18 years, or 20 years of military and civil service, or completing 55 years, or service ending by death, incapacity or reaching the statutory retirement age. Anyone in whom none of these cases is met is entitled to the award under this article. To assess a particular case, one may consult a lawyer specializing in administrative cases.
Practical example
Soldier Salem served 12 years of actual military service, and his service then ended without a disciplinary ruling, absence or a crime, and none of the cases of entitlement to a pension was met in his case. Under paragraph (a) he is entitled to an award of 5 salaries for the first five years, 10 salaries for the following five years, and 6 salaries for the two years beyond, that is 21 salaries calculated on the last salary he was receiving.
