Article 31 explained in plain English
This article determines the jurisdiction of the general courts, and is built on two ideas:
First: general (comprehensive) jurisdiction: the general courts have jurisdiction to hear all cases, lawsuits, evidentiary certifications (ithbat inha'iyya) and the like, that fall outside the jurisdiction of the other courts, the notaries and the Board of Grievances. They are the forum for everything not assigned to another body.
Second: what they have jurisdiction over in particular:
- (a) Cases relating to real estate, including: a dispute over ownership or over a right connected to it, a case for harm from the real estate itself or from those benefiting from it, a case concerning its benefits (usufruct), eviction, payment of rent, or participation in it, a case to stop interference with its possession or to recover it, and the like, unless the Law provides otherwise.
- (c) Cases arising from traffic accidents and from violations provided in the Traffic Law and its Implementing Regulations.
Paragraph (b) was deleted from this article by Royal Decree No. (M/101) dated 14/11/1442 AH, which is why the text moves from paragraph (a) to paragraph (c).
Note that the general courts' jurisdiction over real estate cases is qualified by the phrase "unless the Law provides otherwise"; if a statutory provision assigns a particular type of these cases to another body, it is applied.
Article 32 complements this provision, as it makes the general court in a governorate or center that has no specialized court competent over what falls within the jurisdiction of that specialized court, unless the Supreme Judicial Council decides otherwise. Article 30 is also connected to it regarding the extension of jurisdiction to preliminary questions, incidental requests and connected requests.
To determine the court competent over your real estate or traffic dispute, it is advisable to consult a lawyer specializing in procedure and litigation.
Practical example
Abdulaziz leased his apartment in Riyadh, and the tenant stopped paying rent and refused to vacate. A case for eviction and payment of rent is one of the real estate cases over which the general court has jurisdiction in particular under this article, unless the Law provides otherwise.
