Article 9 explained in plain English
This article deals with cases of obtaining the allowance without entitlement, in three paragraphs:
- Repaying the full amount: a beneficiary who deliberately provided incorrect data or information in order to obtain the allowance must repay the whole amount of the allowance paid to them. The condition here is deliberateness and purpose.
- Referral: the Fund may refer anyone who provides incorrect data or information in order to obtain the allowance to the competent authorities to take legal measures against them. The article does not specify those measures.
- Recovery: the Fund or its delegate may take all necessary measures to recover amounts of the allowance paid to the beneficiary that it was established they were not entitled to.
The difference between the first and third paragraphs is important: the first concerns deliberate misleading and requires repaying the whole allowance, while the third concerns amounts established as not due, even without deliberateness, such as someone whose allowance continued to be paid after one of the conditions ceased to be met.
The article is linked to Article 8, which stops payment of the allowance immediately if any condition of entitlement ceases to be met for the beneficiary; if payment continued after the condition ceased, the amounts paid were not due. Anyone facing a recovery claim or a referral should consult a lawyer who specializes in administrative cases.
Practical example
Mazen deliberately concealed that he was employed at a private company in order to obtain the allowance. When this is discovered he must repay the whole amount of the allowance paid to him, and the Fund may refer him to the competent authorities.
