Article 6 explained in plain English
This article addresses the relationship between the depositor and the general warehouse from two sides:
First: the depositor's obligation
The depositor must give the general warehouse all correct details and information about:
- the type of the goods and materials stored,
- their specifications,
- and their value.
This matters because the documents the warehouse keeper issues are built on these details. The storage receipt, as Article 2 defines it, states the type, quantity and value of the goods and the insurance details, and the pledge document contains the details of the goods and their value.
Second: the depositor's right
The depositor has the right to inspect the goods delivered to the general warehouse for his account and to take samples or specimens of them, after coordinating with the warehouse keeper. The right is established, but it is exercised through coordination, not by entering the warehouse whenever he wishes without arrangement.
This article is linked to Article 7, which makes the warehouse keeper responsible for the deposited goods within the limit of their value recorded in the deposit documents, which shows why the accuracy of the details given on value matters. It is also linked to Article 5 on loans secured by a pledge of the goods. A person who has a dispute with the warehouse over the details or the inspection may consult a lawyer specializing in commercial matters.
Practical example
Khalid deposited a consignment of coffee in a general warehouse in Riyadh and gave correct details of its type, specifications and value. After a while he wanted to show a sample to a prospective buyer. Under this article he has the right to inspect the goods and take a sample after coordinating with the warehouse keeper.
