Article 4 explained in plain English
This article sets out who is subject to the Law and the nature of the coverage.
The nature: the Law applies compulsorily. Neither the GCC national nor the employer has a choice about applying it once the conditions are met.
To whom? To GCC nationals who work outside their own state in any member state.
The three conditions (all must be met):
- The provisions and conditions of the civil retirement or social insurance law of his state apply to him.
- He works for an employer subject to the civil retirement or social insurance law in the state of the workplace.
- He holds the nationality of a GCC state, and submits supporting documents proving this.
Note that the first two conditions link two laws: the law of the home state determines whether the person himself is covered by insurance, and the law of the state of the workplace determines whether the employer is covered.
In practical terms, a GCC national working in another state is not subject to the Law merely because of his nationality; all three conditions must be met. If, for example, the law of his state does not apply to him, or the employer is not subject to the law of the state of the workplace, this article does not apply to him.
Article 5 sets out the insurance branches to which the application of the Law is limited. Article 3 entrusts its application to the retirement and insurance bodies.
To apply this to a specific case, it is advisable to consult a lawyer who specializes in social insurance and retirement laws.
Practical example
Saeed is an Omani national who works for a private company in Jeddah. If the Omani insurance law applies to him, the company is subject to the insurance system in the Kingdom, and he submits proof of his nationality, the Law applies to him compulsorily.
