Article 14 explained in plain English
This article sets out when an employee's or worker's participation is stopped under the Law.
The rule: participation is stopped if the employee or worker loses any one of the conditions for coverage set out in Article 4.
What are the conditions of Article 4? According to its text, the Law applies compulsorily to GCC nationals working outside their own state in any member state, provided that:
- The provisions and conditions of the civil retirement or social insurance law of his state apply to him.
- He works for an employer subject to the retirement or insurance law in the state of the workplace.
- He holds the nationality of a GCC state, with supporting documents submitted.
These conditions are not only conditions for starting; they must continue throughout the period of participation, and if one of them ceases to exist, participation is stopped.
Illustrative examples: moving to work for an employer not subject to the law of the state of the workplace, or the law of his own state ceasing to apply to him.
The article does not explain the effect of the stoppage on earlier periods or entitlements, or its procedures. Article 15 obliges the employer to give notice of the end of the employee's service.
To apply this to a specific case, it is advisable to consult a lawyer who specializes in social insurance and retirement laws.
