Article 19 explained in plain English
This is a supplementary article that fills the gap on matters the Unified Law does not address.
The rule: all the provisions of the civil retirement or social insurance law of the home state apply to the employee or worker.
The two limits:
- On matters for which this Law has no specific provision: if the Unified Law regulates a matter, its specific text applies.
- To the extent they do not conflict with its provisions: if a provision of the home state's law conflicts with the Unified Law, the Unified Law prevails.
Order of authority:
- First: the specific provisions of the Unified Law.
- Second: the law of the home state, on matters the Law does not address and to the extent it does not conflict with it.
The idea is that the Unified Law cannot regulate every detail of retirement and insurance, so it leaves the rest to the law of each state, while ensuring that its own specific rules remain the governing ones.
In practical terms, anyone looking for the rule on an insurance question for a GCC national working in another state starts with the Unified Law, and if he finds no provision in it, turns to the law of the home state. Article 18 provides that entitlements are settled under the law of the home state, and Article 20 provides that no financial obligations arise for the workplace state's body.
To apply this to a specific case, it is advisable to consult a lawyer who specializes in social insurance and retirement laws.
