Article 53 bis explained in plain English
This article regulates leave to sit an academic exam, which was added to the Law by Royal Decree No. (M/11) dated 10/3/1424 AH. Its provisions are:
- Purpose: sitting the academic exam.
- Duration: the period needed to sit the exam, without specifying a particular number of days.
- Condition: that the member provides what proves the exam and its duration.
- Recall and cancellation: the member may be recalled from this leave or it may be canceled for reasons required by work circumstances.
It is an independent leave that the Law listed among the types of leave, and its duration is tied to the exam itself, so it is as long as is needed to sit it.
Proof is an essential condition: the member must provide what shows that he will sit an exam and how long it lasts. The article does not specify the type of document required, nor the academic level covered.
Granting is also permissive in the word "may", and the leave can be recalled or canceled if work circumstances require. The article does not state what follows from recalling the member from this leave. Anyone whose request is refused may consult a lawyer specialized in administrative matters and military service affairs.
Practical example
Corporal Hossam studies in an evening university program, and has final exams lasting three days. He may be granted exam leave for the period needed for his exams, on condition that he provides what proves the exam dates and their duration, and he may be recalled from it if work circumstances require.
