Article 53 bis 2 explained in plain English
This article governs study-accompaniment leave, which was added by Royal Decree No. (M/28) dated 26/3/1442 AH. Its provisions are:
- The beneficiary: the enlisted member who wishes to accompany his wife who is on a scholarship to study abroad, or one of those he is legally responsible for supporting.
- The competent authority: it is granted by decision of the Minister.
- The period: for the period of the accompaniment.
- Pay: it is without pay.
- Effect on service: the period is not counted for retirement and promotion purposes.
In practical terms, this leave allows the enlisted member to accompany the scholarship holder for the period of accompaniment, with two effects stated by the text: no pay during it, and its period is not counted for retirement or promotion.
Note that the scholarship concerned is for study abroad, and that the person accompanied is either the wife or one of those the member is legally responsible for supporting. The grant is also permissive, in the wording "may," and depends on the Minister's decision.
Anyone considering requesting this leave who wants to assess its effect on his career may consult a lawyer specializing in administrative cases and military service matters.
Practical example
The wife of Sergeant First Class Abdulmajeed obtained a scholarship for a master's degree abroad for two years, and he wanted to accompany her. By decision of the Minister he may be granted study-accompaniment leave for the two years, without pay, and this period is not counted toward his retirement or promotion.
