Article 85 explained in plain English
This article of the Implementing Regulations of the Criminal Procedure Law deals with the case of issuing a new order to arrest or detain the accused under Article 122 of the Law, and falls within Chapter Nine on temporary release.
The article provides two things:
- Following the usual procedures: The procedures provided in the Law and the Regulations are followed in issuing the new order. The new order is not an exception to the safeguards but is subject to the same procedures, including, for example, the details Article 79 of the Regulations requires in a detention order.
- Respecting the periods: This is without prejudice to the periods provided in Article 114 of the Law.
This article does not state the cases in which the new order may be issued, or the length of the periods referred to, because it refers on this to Articles 122 and 114 of the Law, which should be consulted in their text.
This article is linked to Article 84 of the Regulations, which requires a person temporarily released to undertake to attend if asked and to designate a place for receiving notices, and to Article 86, which regulates the court's release of a detained accused or its detention of a released accused by a reasoned decision for a set period.
If you were arrested or detained again after temporary release, it is best to consult a lawyer who specializes in criminal cases.
Practical example
Nasser was temporarily released in a case in Dammam, then a new order was issued to detain him. This order must be issued under the procedures provided in the Law and the Regulations, without prejudice to the periods provided in Article 114 of the Law.
