Article 84 explained in plain English
This article of the Implementing Regulations of the Criminal Procedure Law sets out the accused's obligations when the investigator issues an order for his temporary release.
The accused must do two things:
- Undertake to attend: He must undertake to attend if asked to.
- Designate a place for notices: He must designate a place, as provided in Article 121 of the Law, in the town of the court within whose territorial jurisdiction the investigation is conducted, to receive the necessary notices.
This is recorded and added to the case file, so that the undertaking and the designated place are established in the papers.
Temporary release therefore does not mean the case is over; the accused remains tied to the investigation, and the investigating body needs to know a place where he can be notified. This article does not state what follows from breaching the undertaking, and does not explain the content of Article 121 of the Law.
This article is linked to Article 83 of the Regulations, which makes it a condition for issuing a temporary release order that the evidence against the accused not be sufficient in a major crime, and to Article 85, which regulates issuing a new order to arrest or detain the accused under Article 122 of the Law.
If you have been temporarily released and want to know your obligations precisely, you can consult a lawyer who specializes in criminal cases.
Practical example
The investigator temporarily released Sami in a case being investigated within the territorial jurisdiction of a court in Riyadh, while Sami lives in Kharj. Sami undertakes to attend if asked and designates a place in Riyadh to receive notices; this is recorded and added to the case file.
