Article 86 explained in plain English
This article of the Implementing Regulations of the Criminal Procedure Law deals with the court's authority to release or detain the accused under Article 123 of the Law, in six paragraphs:
- The release decision: If the court decides to release the detained accused, it issues a decision to that effect, and may make it conditional on any guarantee it sees fit. The public prosecutor's objection to it is under the provisions on objection before judgment on the merits.
- The detention decision: If it decides to detain the released accused, it issues a detention decision for a set period and with reasons.
- Recording: The court records the decision to release or detain, or to continue detention, in the court record of the case.
- Contents of the release decision: The name of the circuit, the case registration and referral numbers and their dates, the full name of the accused, his nationality and ID number, the charge, and a reference to the reasons for the decision and that it is limited to the case in which it was issued.
- Notification: The court notifies the Bureau of the decision to release as soon as it is issued.
- Effect of objection: The public prosecutor's objection to the decision to release the accused does not stop its execution.
The sixth paragraph means that an accused released by the court's decision does not remain detained merely because the public prosecutor objects. The article does not state the types of guarantees; they are left to the court's discretion.
It is linked to Article 85 of the Regulations on issuing a new order of arrest or detention, and to Article 87 on archiving the case.
If you are requesting the release of a detained relative before the court, it is best to consult a lawyer who specializes in criminal cases.
Practical example
A criminal court in Jeddah decided to release a detained accused against a guarantee it saw fit, and the public prosecutor objected to the decision. This objection does not stop the execution of the release decision, and the court notifies the Bureau of the decision as soon as it is issued.
