Article 101 explained in plain English
This article of the Regulations deals with a special offense committed inside the court itself: assault during the session on:
- The court panel.
- One of its members.
- One of its employees.
If the court decides to try the person who committed this assault, it must:
- Record what happened in the record of the original case it was hearing.
- Issue judgment on this offense in an instrument separate from the instrument of the original case.
- Apply to this judgment the provisions of the Law and the Regulations, so it is not excluded from the general rules such as methods of objection and others.
Separating the two instruments preserves the independence of each case: the original case continues on its subject, and the assault offense has its own judgment. Article 102 of the Regulations refers to this article where the court hears an offense based on Article 144 of the Law.
The article does not state the penalty for assault, so refer to the specific provisions for that.
If you have a pending case and need advice on your specific situation, it is best to consult a lawyer who specializes in criminal cases.
Practical example
While a case was being heard at a court in Dammam, one of those present assaulted the session clerk. The court decided to try him, so it recorded the incident in the original case record and issued judgment against him in a separate instrument to which the provisions of the Law and the Regulations apply.
