Article 102 explained in plain English
This article of the Regulations sets what the court does when facing an offense to which Article 144 of the Criminal Procedure Law relates, and distinguishes between two options:
- If the court decides to hear the offense itself: it observes what is stated in Article 101 of the Regulations, that is, it records the incident in the original case record and issues judgment in a separate instrument, to which the provisions of the Law and the Regulations apply.
- If it decides to refer it: either to the Bureau (which under Article 1 of the Regulations is the Bureau of Investigation and Public Prosecution) or to another court competent to hear the offense, it draws up a detailed report to that effect which is attached to the case file.
In both cases the file of the original case remains documented: either by the separate judgment and its recording, or by the referral report. The article does not explain when the court chooses to hear or to refer, so refer to Article 144 of the Law for that.
Article 117 of the Regulations refers to this article in the discretionary punishment of a false witness.
If you have a pending case and need advice on your specific situation, it is best to consult a lawyer who specializes in criminal cases.
Practical example
During a session at a court in Riyadh an offense occurred which the court considered to be within the jurisdiction of another court. It did not hear it itself, but referred it to the competent court, and drew up a detailed referral report which was attached to the file of the original case.
