Article 100 explained in plain English
This article of the Regulations regulates the procedural side of keeping order in the session, and contains two provisions:
- Recording: the court must record what happens that disrupts the order of the session, either in a report or in the case record. This preserves proof of the incident and of what was done about it.
- Imprisonment order: if an order is issued to imprison whoever disrupts the order of the session, based on Article 142 of the Criminal Procedure Law, it is drawn up by official letter and sent to the competent authority for execution.
This article does not set the length or conditions of imprisonment; it only regulates how the order is documented and sent, while the basis and limits of imprisonment are found in Article 142 of the Law.
Article 119 of the Regulations refers to it in dealing with whoever tries to intimidate or disturb witnesses.
If you have a pending case and need advice on your specific situation, it is best to consult a lawyer who specializes in criminal cases.
Practical example
During a session at a criminal court in Jeddah, one of those present repeatedly raised his voice and interrupted the session. The court recorded what happened in the case record, and when it issued an order to imprison him based on Article 142 of the Law, it drew it up by official letter and sent it to the competent authority for execution.
