Article 210 explained in plain English
This article is the basic rule of the sea carrier's liability for goods.
1- The rule: the carrier is liable for loss resulting from loss of, damage to or delay in delivery of the goods if the incident occurred while they were in his custody, unless he proves that he, his servants or his agents took the measures required to avoid the incident and its consequences.
2- Delay: it occurs if the goods are not delivered at the port of discharge within the agreed period or, if there is no agreement, within the period that is reasonable for an ordinary carrier in similar circumstances.
3- Treating the goods as lost: the person entitled to claim compensation may treat the goods as lost if they are not delivered within sixty consecutive days of the end of the delivery period.
4- Fire: the carrier is liable if the claimant proves that the fire arose from fault or negligence by the carrier, his servants or his agents, or from their failure to take the measures required to extinguish it and mitigate its consequences.
5- Live animals: he is not liable for the special risks inherent in carrying them, and if he followed the shipper's instructions, the damage is presumed to arise from these risks until the shipper proves fault by the carrier, his representative or his servants.
6- Rescue: he is not liable for what results from measures to save lives or property at sea, except for general average.
7- Concurrent causes: if the carrier's fault combines with another cause, he is liable only to the extent attributable to his fault, provided he proves the amount that is not attributable to it.
It follows Article 209, which sets the custody period. It is followed by Article 211, which exempts the carrier from the liability in paragraph 1 if he proves that the loss or damage is due to an external cause in which he had no hand. To claim compensation, it is advisable to consult a lawyer specializing in maritime and commercial law.
Practical example
A shipment of devices was due to be delivered to a merchant in Jeddah on May 1 and did not arrive. If sixty consecutive days pass after this date without delivery, the merchant may treat the goods as lost and claim compensation from the carrier, unless the carrier proves he took the required measures.
