Article 6 explained in plain English
This article specifies how the Center's board of directors is formed and the conditions for its members:
- Instrument of formation: an order of the Prime Minister.
- Nomination: agreed between the Ministry of Commerce and Investment and the Ministry of Justice, in coordination with the Federation of Saudi Chambers of Commerce. The phrase "Federation of Saudi Chambers of Commerce" replaced "the Standing Committee" by Council of Ministers Resolution No. (68) dated 21/1/1445 AH.
- Term of membership: 3 years, renewable once only.
- Experience: the chair, the deputy chair and the members must have previously worked in the relevant private sector for no less than 10 years for the chair and 5 years for the members.
- No combination with government work: none of them may hold a government position or post.
Note that the text states 10 years for the chair and 5 years for the members, and does not specify a separate period for the deputy chair.
The aim of the private-sector experience requirement is that the Center be run by people who know the nature of the commercial disputes whose arbitration the Center supervises.
