Article 25 explained in plain English
This article opens a way to fill the work of some posts through contracting instead of ordinary appointment. Its text is: contracting may be used to perform the work of some posts as the Regulation specifies.
Three things follow from the text:
- Contracting is permitted; it is not the primary way of filling posts.
- It concerns some posts, not all of them.
- Determining these posts and the conditions and provisions of contracting is as the Regulation specifies.
The article does not say which posts may be filled by contract, or the term of the contracts or the rights arising from them; it leaves all of that to the Regulation. Anyone working, or wishing to work, under a contract at a government entity therefore needs to consult the Regulation to learn which provisions apply to him.
The article was amended by Royal Decree No. (M/73) dated 27/5/1441 AH to take its current text.
This article differs from Article 25 bis, which deals with contracting with consultants and experts to perform a particular service under a model contract agreed between the government entity and the Ministries of Civil Service and Finance. Article 24 also provides that an outstanding employee may be granted a cash reward.
Anyone with a dispute over his contract with a government entity would do well to consult a lawyer specializing in administrative cases and civil service matters.
