Article 5 explained in plain English
This article allows the Central Bank to charge a fee for four types of work:
- Issuing licenses.
- Approvals.
- The services and operations it performs.
- The cost of supervising financial institutions.
The condition is that it be under controls the Board approves, meaning the Bank's board of directors. The article does not set any amount or percentage, or the method of calculation; it leaves that to the controls the Board approves.
Note that the provision is optional ("the Bank may charge"), so the Bank is not required to charge a fee in every case.
The fourth item matters for financial institutions, which under Article 1 are any natural or legal person subject to the Bank's supervision, oversight and regulation; it means the costs of the Bank's supervision of them may be collected from them under those controls.
This article is linked to Article 4, which lists the Bank's tasks, including issuing rules and licenses for payment systems and fintech platforms and supervising and overseeing financial institutions; these are the work for which the Bank may charge a fee. It is followed by Article 6, which prohibits the Bank from certain activities, including engaging in trade, financing or lending to the government, and financing or lending to any person other than financial institutions for managing liquidity or addressing crises.
Anyone applying for a license who wants to know the fee required should consult the controls approved by the Bank's board.
Practical example
A finance company in Jeddah applies to the Central Bank for a license for a new activity. Under this article the Bank may charge it a fee for issuing the license, and its amount is known from the controls approved by the Bank's board of directors.
