Article 82 explained in plain English
This article of the Regulations governs the meeting of the deceased debtor's heirs and creditors, under Article 219, Article 220 or Article 221 of the Bankruptcy Law.
1. Setting the date
- The court sets the date at the request of any of the heirs or creditors.
- The date must fall within a period not exceeding 30 days from the date of the request.
- The exception is where the court, in cases it assesses, sets the date later, by no more than another 30 days.
2. Announcing the date
The person who requested the meeting announces the set date within 5 days of the date of the court's decision setting it. The announcement is the responsibility of the applicant, not the court.
3. Running the meeting
The meeting is run according to the rules for running meetings, which, under Article 1 of the Regulations, are rules issued by the Minister for running meetings relating to bankruptcy procedures.
The article follows Article 81, which allows the court to appoint a temporary trustee to manage the deceased debtor's business during the protective settlement. This article does not explain the content of Articles 219, 220 and 221 of the Law or what is discussed at the meeting, so those articles should be consulted. Anyone who is an heir or creditor should preferably consult a lawyer specializing in bankruptcy and commercial cases.
Practical example
The owner of an establishment in Riyadh died owing debts to several suppliers. One of the suppliers asked the court to set a date for a meeting of the heirs and creditors, and the court set it within 30 days of the request. The supplier who applied must announce the date within 5 days of the court's decision, and the meeting is run according to the rules for running meetings.
