Article 8 explained in plain English
This article of the Implementing Regulations of the Bankruptcy Law explains the means of delivering notices and documents in bankruptcy procedures, and sets two further provisions.
1- Means of sending: any notice, document or information provided for by the Law or the Regulations, and anything equivalent, may be sent by any of the following:
- The national address.
- Text messages sent to the verified mobile phone.
- Email.
- Accounts registered in any of the government automated systems.
The text mentions electronic means with the phrase "including," meaning that what is mentioned are examples of electronic means.
2- Multiple trustees: if there are several trustees in the procedure, notifying the person the court chooses as head of the trustees, or handing that person information or documents, counts as notice or delivery to the rest of the trustees.
3- Invitation to meetings: the invitation to hold any meeting must include: the date on which it is held, its time, and its place.
Relation to neighboring articles: Article 7 requires the debtor and the trustee to document all acts in the bankruptcy procedure in writing, and Article 9 requires correspondence, notices, approvals, agreements, warnings, requests and any other document under the Law or the Regulations to be in writing.
In practice it is useful for creditors and debtors to update the national address, the verified mobile number and the email, because notice may reach them through these. Anyone with a question about the validity of a particular notice in their case would do well to consult a lawyer specializing in bankruptcy cases.
Practical example
A supplier in Riyadh has a claim against a company subject to a liquidation procedure. The trustee sent him an invitation to the creditors' meeting by text message to his verified mobile phone, and the invitation included the date, time and place of the meeting. This is one of the means this article permits.
