Article 6 explained in plain English
This article of the Implementing Regulations of the Bankruptcy Law sets the general rules for official communication in bankruptcy procedures, and distinguishes between two things: notice and announcement.
- Notice: every notice issued by the debtor, the trustee or the Bankruptcy Committee under the provisions of the Bankruptcy Law and its Regulations must be in the form specified for this purpose. The article does not state the content of this form.
- Announcement: every announcement issued by the debtor, the trustee or the Bankruptcy Committee under the Law and the Regulations is made on the Bankruptcy Committee's website.
If notice is impossible: paragraph 3 provides that if the notice required by the Law and the Regulations is impossible, an announcement is made to the person who could not be notified, and the effects of notice take effect from the date of the announcement. That is, the effects that would have followed from notice are counted from the date of the announcement.
The court's power: the court may order the debtor, the trustee or the Bankruptcy Committee to give notice of or announce any judgment, decision or procedure.
Relation to neighboring articles: Article 7 requires the debtor and the trustee to document all acts in the bankruptcy procedure in writing. Article 5 allows the court, after registration of a request to open any of the liquidation procedures, to order the appointment of a trustee or the seizure of the debtor's assets.
In practice it is useful for creditors and debtors to follow the Bankruptcy Committee's website, because an announcement there takes the place of notice for someone who could not be notified. When in doubt about the running of a period tied to a notice or announcement, a person would do well to consult a lawyer specializing in bankruptcy cases.
Practical example
A creditor changed his address without updating his details, so the trustee was unable to notify him of a decision concerning the bankruptcy procedure of a company in Riyadh. In this case the decision is announced on the Bankruptcy Committee's website, and the effects of notice take effect against this creditor from the date of the announcement.
