Article 9 explained in plain English
This article of the Regulations specifies what the request for arbitration provided for in Article 26 of the Arbitration Law, which the claimant files, must contain.
The required particulars (paragraph 1):
- The claimant's name, and the name of its representative if any, the occupation of each, nationality, domicile, address and means of communication.
- The name of the other party to the arbitration.
- A brief statement of the contractual relationship, the arbitration agreement, the subject of the dispute, its facts, and the circumstances that led to the filing of the request for arbitration.
- A summary of the claimant's requests.
- A proposal for appointing the arbitrator if the composition of the arbitral tribunal is not specified and there is a sole arbitrator, or notice of the appointment of the arbitrator chosen by the claimant if the tribunal consists of three or more.
Dispute over the sufficiency of the particulars (paragraph 2): if a dispute arises over the sufficiency of the particulars included in the request, this does not prevent the arbitral tribunal from being formed, and the tribunal itself decides this dispute. Forming the tribunal therefore does not wait for this objection to be decided.
This article is linked to Article 8 of the Regulations, on notifying the parties of the procedures the tribunal chooses when they do not agree on them, and to Article 10, under which the competent court selects the sole arbitrator within fifteen days if the parties do not agree on choosing him.
Preparing a complete request for arbitration takes care over the drafting, the facts and the requests, so you should consult a lawyer who specializes in arbitration and commercial cases when preparing it.
Practical example
Khalid, who owns a contracting business in Riyadh, wanted to start arbitration against a company that had not paid his dues, and the contract between them provides for a sole arbitrator without naming him. He included in his request his name, occupation, nationality, domicile, address and means of contact, the company's name, a brief statement of the contract, the arbitration clause and the facts of the dispute, a summary of his requests, and a proposal for appointing the arbitrator.
