Article 45 explained in plain English
This article regulates the urban heritage register and its classification.
Paragraph (1) – The register and categories: all urban heritage sites, buildings and areas are recorded in it, in grades:
- (A) high importance, (B) medium importance, (C) little importance.
Paragraph (2) – What classification covers:
- The building or site or parts of them, including the movable antiquities connected with them, such as fixtures, windows, doors, furniture, paintwork and decorations.
- Urban areas made up of several buildings that form an urban fabric, and surrounding areas that are necessary to protect, display or use the registered building or site.
- Surrounding or complementary natural areas that form part of the planned environment, such as gardens and farms.
Paragraphs (3–6): the regulations set the classification criteria, the Authority prepares the registration lists and the President approves them, and registration may be cancelled in whole or in part by decision of the President. If the Authority sees no need to register the site or building, or its registration is cancelled, it permits disposal of it in accordance with the Law and its regulations.
Note that classification may extend to the details of the building such as doors and windows, and to its surroundings such as gardens and farms. Anyone who owns a classified building would be wise to consult a lawyer who specializes in real estate matters.
